If you lend someone one of your possesions and they fail to return it, is that considered stealing?

For example I lent someone my Halo Reach game and they continuously forgot it everyday over a course of 2 months. Now he has moved to South Carolina with my game and I am in New Jersey. Is that stealing and can I file a report with police? No wise crack remarks, just suggestions please.
